Legal details: Individual entrepreneur Vachagan Gabrelyan, Tax ID (TIN) 28288386, Yerevan, Svachyan 50, Armenia.
1. Parties and subject
The service provider is Individual entrepreneur Vachagan Gabrelyan, Tax ID (TIN) 28288386, Yerevan, Svachyan 50, Armenia, operating under the OwnAtmos brand. The provider offers digital distribution services: acting in the name and on behalf of the artist, it delivers the artist's music to streaming platforms, stores and social networks and passes on the royalties received from them (agency model).
2. Acceptance
The artist accepts these terms by ticking the box at sign-up, submitting a release for review or paying for a plan. From that moment the agreement is concluded. The site records the date and version of the accepted terms.
3. Rights to the music
The artist keeps all rights to their recordings, compositions and artwork. By uploading a release, the artist grants the provider a non-exclusive right to distribute it on the selected platforms for as long as the release is live.
4. Artist warranties
The artist confirms that they own all rights to the uploaded music, lyrics, samples and artwork or have obtained the necessary permissions, that the release does not infringe third-party rights or the law, and that streams will not be artificially inflated. The artist is responsible for any infringement.
5. Plans and royalties
- Start — free; the artist receives 80% of the royalties the provider receives from platforms, 20% is the provider's fee.
- Rising, Breakout, Pro — annual subscription; the artist receives 100% of the royalties received.
- Single-release payment — one-time; for that release the artist receives 100% of the royalties received, with no time limit.
- If a subscription is not renewed, releases are not taken down: the account moves to the Start plan with a 20% fee until the next payment.
- Royalties are credited to the artist's balance after reports and funds are received from platforms and are paid out to a bank account on the artist's request.
6. Review and rejection
The provider reviews releases and may refuse to publish a release or take it down if it infringes third-party rights, platform requirements, content rules or these terms, or if artificial streaming is suspected. Copyright complaints are handled under a separate procedure.
7. Refunds
Refunds for plans and releases are governed by the Refund policy, which forms part of these terms.
8. Takedown and termination
The artist may request a takedown at any time. A takedown may take up to several weeks depending on the platforms. Royalties already accrued are paid out under the general rules.
9. Liability
The provider is not responsible for platform decisions (publication timing, playlist placement, content removal), platform outages, or delays in reports and payments by platforms and partners.
10. Minors
Artists under 18 use the service with the consent of a parent or legal guardian, who accepts these terms on their behalf.
11. Governing law and disputes
This agreement is governed by the laws of the Republic of Armenia. Disputes are settled by negotiation or, failing that, by the court at the provider's location.
12. Changes and contact
The provider may update these terms; the new version is published on the site and the artist is asked to accept it at the next sign-in. Questions: info@ownatmos.com.
